Ocean County Man Sues Dunkin' for 2nd Degree Burns From Hot Coffee
A man from Ocean County is claiming Dunkin' for carelessness after he claimed to have had second-degree burns from hot coffee that spilled down his lap due to a loose lid.
According to the lawsuit, which was submitted in Ocean County Superior Court, Cosimo Nistico, a resident of Berkeley, placed an order for a cup of coffee this past April at a
Dunkin' drive-thru on Route 37 in Toms River.
However, the lawsuit claims that because the coffee cup's lid was not properly fastened, hot coffee spilled over Nistico's lap, causing second-degree burns to his left thigh.
According to the lawsuit, Nistico had "great pain and suffering," needed medical care, and found it challenging to carry out his regular activities as a result.
Dunkin' is implicated in the lawsuit, along with a number of other anonymous workers and businesses.
Nistico is asking for compensatory damages and a jury trial.
According to earlier reports from Patch, Dunkin' has also been sued in cases involving hot beverage spillage in the counties of Morris, Passaic, Bergen, Camden, and Burlington.
An enquiry for comment from Dunkin' did not receive a prompt response.
