Chief Mitchell Little, the emergency management coordinator for the Toms River Police Department, has declared an emergency due to the storm this weekend.
Although there will still be lifeguards on duty at the beaches, swimming will not be allowed while the red flag warning is in effect due to the risk that rip currents pose to beachgoers and our coastline area.
Anyone who violates the law could face charges for being a disorderly person. NJSA App.A:9-49. Violations as disorderly conduct; penalty; prosecution.
Toms River has prohibited swimming at its bay and ocean beaches and has issued a warning to anyone caught disobeying the rule; this comes as dangerous wave conditions and ocean rescues continue to plague the Jersey Shore.
The emergency management coordinator for the township, Toms River Police Chief Mitchell Little, issued an executive order on Friday prohibiting swimming in the ocean in Toms River's North Beach and
Ortley Beach portions.
The emergency order stated that swimming is prohibited until the red flag warning is rescinded. According to the police department, violators will be charged as disorderly persons.
The maximum penalty is $1,000 in fines, 6 months in jail, or both, according to the legislation.
This late in the season, I do not want anyone to drown, Hill added. Individuals must use common sense.
