Assault by Auto Charges Filed Against Driver in Toms River Crash

According to Ocean County Prosecutors Office, an Ocean County man has been charged following an early Saturday crash on Bay Avenue in Toms River that left two persons injured.

Prosecutor Bradley D. Billhimer stated that Erick Perez-Ramirez, 40, of Jackson, has been charged with two counts of assault by auto in relation to the collision that occurred on Bay Avenue close to Ethan Court on Saturday morning at 4:45 a.m.

Both Toms River residents Viviana Arciniegas-Diaz, 33, and Maria Vega-Diaz, 33, were brought to Jersey Shore University Medical Center in Neptune for medical attention, according to Billhimer. He stated both were marked as steady.

Perez-Ramirez was traveling east on Bay Avenue in a 2020 Chevrolet Silverado when he failed to yield to a right turn in the road, leaving it instead, and collided with a tree, according to the preliminary inquiry.

Authorities reported that Vega-Diaz was seated in the back seat and Arciniegas-Diaz was seated in the front. William Rubiano, 31, of Toms River, was reportedly also in the rear seat.

According to the officials, Rubiano and Perez-Ramirez were unharmed.

Perez-Ramirez seemed to be drunk when the responding police officers gave him field sobriety tests, which he failed, according to the authorities.

After being accused with driving under the influence and being placed under arrest, Perez-Ramirez was brought to the Community Medical Center in Toms River, where a court-authorized warrant was used to extract his blood.

The blood draw's outcomes are still unknown.

In anticipation of a detention hearing, Perez-Ramirez is being detained at the Ocean County Jail in Toms River, according to Billhimer.
