Ocean County Man with Autism Dies After Falling from Third-Floor Window

Despite being required to have one-on-one supervision at all times, the family of a Brick Township man with autism claims he fell to his death from a third-floor window when workers at the day program he attended lost sight of him, according to court documents and the family's attorney.

According to the tort claim notice submitted on Wednesday by Daryl L. Zaslow on behalf of Justin's parents, Kimberlee and Jeffrey McCafferty, Justin McCafferty, 22, passed away at the Fort Monmouth Day Program in Oceanport on April 15.
According to Zaslow, Justin had been enrolled in the Fort Monmouth Day Program for persons with autism who are 21 years of age or older for around two years.

The tort claim, which is a preliminary notice of a lawsuit, states that Justin, who was diagnosed with profound autism at a young age, was attending the program on April 15 when the staff at the Fort Monmouth Day Program lost sight of him despite a requirement that the staff have direct line-of-sight supervision and one-on-one care and protection at all times.

According to Zaslow, he was discovered by a Good Samaritan after falling to the ground outside the building after gaining access to a third-floor window or the facility's roof.

Police and emergency medical personnel arrived after the onlooker attempted to console and revive Justin. According to Zaslow and the tort filing, he was transported to Monmouth Medical Center in Long Branch, where he eventually passed away.
According to Oceanport Detective Kelly Siegle's email to Patch, the incident occurred in the morning and is being investigated by the Monmouth County Prosecutor's Office Major Crimes Bureau and Oceanport police.

A request for comment was not immediately answered by representatives of the Fort Monmouth Day Program.
