The Monmouth County Prosecutor's Office announced Friday that a Union County police officer who lives in Toms River has been charged with two counts of vehicular homicide in a fatal October incident in Tinton Falls in which authorities claim he was inebriated.

Prosecutor Lori Linskey charged John P. McClave III, 34, of Toms River, a member of the Hillside Police Department, with two counts of second-degree vehicular homicide in the Oct. 9, 2021, crash that killed a married couple from Baltimore.

Angel L. Acevedo Jr., 40, and his wife, Daniela Correia Salles, 35, both suffered very severe injuries and were pronounced dead at the scene of the incident on Asbury Avenue in Tinton Falls soon before 7:30 p.m. Linskey explained.

McClave was driving a 2018 GMC Canyon pickup truck to work when he went off the Garden State Parkway near the Parkway overpass near Asbury Avenue and collided with Acevedo's 2020 Toyota Corolla, according to officials.

McClave's vehicle did not reverse direction or slow down considerably after leaving the Parkway lanes, causing it to become airborne when it hit an embankment before colliding with the victims' automobile, according to investigators.

According to investigators, McClave was rushed to Jersey Shore University Medical Center with critical but not life-threatening injuries.

According to authorities, McClave was driving his vehicle recklessly while under the influence of intoxicating substances at the time of the collision, according to an investigation by the multi-jurisdictional Monmouth County Serious Crash Analysis Response Team (SCART), the MCPO Fatal Accident Unit, and the Tinton Falls Police Department.

According to Linskey, McClave was also charged with careless driving, failure to maintain lanes, failure to wear a seatbelt, and possessing an open container of alcohol in a vehicle.

According to Linskey, the Prosecutor's Office is submitting a motion to have McClave imprisoned pending the outcome of the case.

Under the state's No Early Release Act, McClave faces up to ten years in state prison if convicted, with 85 percent of the sentence completed before the possibility of parole for each offense.
